1 Petitioner Myron Stephenson, the presumed father of the child involved in the underlying custody dispute, brings this special action from the trial courts order requiring him to submit to paternity testing. Petitioner contends that the trial court abused its discretion in requiring such testing without a prior determination that paternity testing is in the best interests of the child, or, in the alternative, without conducting an evidentiary hearing to determine the merits of the biological mothers collateral attack on the validity of her previously executed affidavit of acknowledgement of fathers paternity. Although we disagree with fathers first contention, we agree with his second argument, and for the following reasons, we accept special action jurisdiction and grant relief.
